Quick info

Foreigners who have received a residence permit for taking up employment as former persons with temporary suspension of deportation (Geduldete) can apply for the extension of their temporary residence permit.

Description

You can apply for the extension of your residence permit issued for the purpose of employment for qualified persons with a tolerated stay (Geduldete), provided that you continue to pursue employment and also continue to meet the other requirements. As a rule, the same requirements that applied to the initial issuance must be met for the extension of the residence permit. In particular, you must be able to secure your livelihood and health insurance coverage from your own resources without claiming public benefits.

To process your application, the immigration office generally involves the Federal Employment Agency, which reviews the working conditions. After two years of holding the residence permit and if employment corresponding to your professional qualification was pursued during this time, access to the labor market is no longer subject to any restrictions.

In the event of an extension, your residence permit will be granted for a limited period again. As a rule, the residence permit cannot be extended if this was already excluded when the residence permit was issued or last extended.

Procedure

  • Check whether your immigration office allows online applications or provides a special application form.
  • If the application can only be submitted in person, please make an appointment at the Immigration Office. In the case of an online application, the Immigration Office will contact you after receiving your application to arrange an appointment.
  • During the appointment, your identity and documents will be verified (please bring your documents to the appointment, preferably as originals).
  • If your application is approved, your fingerprints will be taken for the production of a new electronic residence title (eAT card). The immigration office will commission the production of the eAT card by the Federal Printing Office. After completion, you will receive information and can collect the residence permit at the responsible office. As a rule, the eAT card must be collected in person.
  • If your application is rejected, you will receive a notice of rejection.
