In certain cases, you can avoid the withholding tax on capital gains from the outset:
tax exemption order
If your taxable investment income does not exceed €801 per year, or €1,602 for jointly assessed spouses or civil partners, an exemption order submitted to your bank is sufficient to prevent the bank from withholding tax on investment income.
You can also split the saver's tax allowance of €801 / €1,602 among several financial institutions. It is not permitted to restrict the exemption order to individual accounts or custody accounts within a single financial institution.
Certificate of non-assessment
If your income, including investment income, does not exceed the basic tax-free allowance for income tax in the calendar year, you can apply for a non-assessment (NV) certificate from your local tax office. The NV certificate will then be sent to you by the tax office.
Upon submitting the non-assessment certificate (NV-certificate) to your bank, they can pay out capital gains without tax deductions. When determining the number of certificates you need, please keep in mind that you require one copy for each bank where you generate capital gains.
An NV certificate will not be issued if you are expected to be or upon request assessed for income tax. Therefore, you will not receive an NV certificate, among other reasons, if a remaining loss carryforward has been determined for you by the tax office.
The non-assessment certificate is issued subject to revocation with a maximum validity period of three years and must end at the end of a calendar year.
