Apply for deviant rest period

Under certain conditions, as an employer for employees in your company, you can have rest periods that deviate from working time regulations approved.

As a general rule, employees have their established 8-hour workday. After finishing work, they are entitled to an uninterrupted rest period of 11 hours. Under certain conditions, as an employer for employees in your company, you can have deviating rest periods from labor time regulations approved by the locally competent supervisory authority of your federal state, specifically:

• for standby duty, on-call duty, and readiness for service in the public service, provided special circumstances exist, such as for winter maintenance services, as well as
• in shift work twice within 3 weeks to achieve a regular weekly shift rotation. This applies to the rest period after workdays as well as after Sundays and public holidays.

The exception is at the discretion of the authority. You have no right to an exceptional permit.

Reduced rest periods are only permitted once a permit has been granted. A retroactive permit cannot be granted.

• The granting of the permit or the rejection of the application is subject to a fee. The fees are calculated based on the administrative effort or depend on the number of employees to be deployed.
