Description

You can have condominium land registers closed again if all condominium ownership rights have become united in your person. The unification may have occurred because you acquired all condominium ownership rights by legal transaction, by succession, or by compulsory auction.

You can also undo the subdivision if, following a subdivision into condominium ownership, you have always remained the owner of all condominium ownership rights because no other owners have joined the community.

This requires your application.

Upon the closure of the condominium land registers, a new land register sheet is created for the property. Any encumbrances of all condominium ownership rights with a joint right continue with identical content on the undivided property. Individual encumbrances are also transferred where applicable. The encumbrances are therefore transferred to the newly created land register sheet.

Procedure

You must apply for the entry at the land registry. As a rule, the notary who certified the application for entry initiates the entry.

  • The documents required for the entry are examined by the responsible judicial officer at the land registry.
  • Should documents be incomplete or not in the proper form, the responsible judicial officer will inform the notary or you in writing and request the submission of the still missing documents or the properly formatted documents (to be notarized or certified).
  • If all necessary documents are available, the competent judicial officer will close the condominium land registers and at the same time create a new land register sheet for the property.
  • The completed registration will be communicated to the notary submitting the application and to you with the registration notice.
  • The invoice of the land registry office is being sent to you for payment of the costs.

Flat fee: EUR 50
The land registry office levies the flat fee separately for the cancellation of each condominium ownership.

In addition to the fees for the activities of the land registry office, fees according to the Court and Notary Costs Act (GNotKG) are also incurred for the activities of the notary. Please inquire about the amount of the notary fees from the notary acting in your case.
