If your company has to permanently reduce staff due to restructurings, you can receive transitional short-time allowance (Transferkurzarbeitergeld) for these employees for a limited period, which partially compensates for the loss of earnings during this time and supports the search for new employment.

Description

If your company has to permanently reduce staff, for example if a department has to be closed for economic reasons, you may be entitled to transfer short-time allowance. The employees affected by the permanent loss of work are brought together in a company-organizational unit. You can receive transfer short-time allowance for these employees.

As the employer or the transition agency, you apply for, pay out, and settle the transfer short-time allowance. This means you initially advance the payment of wages and salaries to your employees. Your employees do not need to do anything in this regard.

The transfer short-time allowance is settled monthly in arrears with the Federal Employment Agency at the location of the payroll office and is paid out to you retroactively.

The amount of the transfer short-time allowance depends on the respective income of your employees:

  • 60 percent of the lost net wages for employees without a child in the household
  • 67 percent of the lost net salary for employees with at least one child in the household.

You will receive the transfer short-time allowance

  • at the earliest from the calendar month in which the notification of the work stoppage was received by the Employment Agency, and
  • for a maximum of 12 months.

However, you cannot receive the transfer short-time allowance simultaneously with the regular short-time allowance or the seasonal short-time allowance.

Before you receive transfer short-time allowance, funding for participation in a transfer measure may precede it. Transfer short-time allowance and the funding of transfer measures can be effectively coordinated with each other. Consult your employment agency about this.

Procedure

You can apply for transfer short-time allowance in writing and online. The procedure is multi-stage. First, you contact your employment agency for transfer counseling. Next, you report the work stoppage, and then you submit the application.

  • You are utilizing transfer consulting services through your employment agency.
  • You are concluding a social plan and reconciliation of interests.
  • You are giving notice to your employees regarding the transition to an outplacement company (transfer company) and the receipt of transfer short-time allowance. A company agreement is frequently concluded with the works council for this purpose. If there is no works council, you must obtain the consent of all employees who will be affected.
  • You report your job losses in writing to your Employment Agency (form: Notification of work shortage in a company unit that is organizationally independent).
  • The Employment Agency examines the notification and decides whether transfer short-time allowance can be granted.
  • You calculate monthly wages and salaries as well as transfer short-time allowance.
  • You pay the transfer short-time work allowance to your employees and remit the social security contributions.
  • You apply monthly in retrospect for the reimbursement of transfer short-time allowance at your local Employment Agency (application for transfer short-time allowance and accounting list).
  • The Employment Agency reviews the application and the statement of account, and approved transfer short-time allowance is transferred. You will receive a written notification regarding this.
  • Your settled benefit periods will be subject to a final review after you stop receiving transfer short-time work benefits.

Deadlines

Before concluding the social plan or the reconciliation of interests, you must attend a transfer consultation with the Employment Agency.
