If you were not informed or not informed in time about the operating air carrier, or if you were not offered alternative transport or a ticket refund in the event of a flight cancellation involving an airline classified as unsafe, you can file a complaint.

Description

Your contractual partner for air travel – meaning the airline or travel company – is required to inform you of the identity of the operating airline at the time of booking. If the operating airline changes, tour operators, travel agencies, or airlines must inform you of the identity of the new airline without delay. In any case, you must be informed of the identity of the operating airline at check-in or, if no check-in is required, at boarding. If you were not notified in a timely manner of a change of the operating airline during air travel, you can file a complaint.

Air carriers classified as unsafe are not permitted to operate flights in the European Union (EU) or are subject to restrictions. The affected companies can be found on the "Blacklist".

If you determine that such an airline is operating the flight, you do not have to take it. The contractual partner must offer you alternative transport or a refund of the ticket costs if

  • your flight was cancelled due to the inclusion of the operating air carrier on the "black list" or
  • you have therefore decided not to take the flight.

If you suspect a violation of the aforementioned requirements, you can file a report.

Uploading supplementary documents is not mandatory. However, booking documents or correspondence with the airline, travel company, or agency, for example, facilitate the processing of your claim and prevent additional inquiries. The Federal Aviation Office will examine the facts of the case and, if necessary, request information from you.

In the event of proven violations, the Federal Aviation Office may impose sanctions in the form of fines against the contractual partner. The purpose of the fines is to prevent violations from recurring in the future.

Regardless of this, any potential civil law claims you may have under the regulation on ticket cost reimbursement remain unaffected.

The Federal Aviation Office is neither authorized to assist you in enforcing these claims under the regulation against the contractual partner, nor to advise you in this regard. If necessary, you must assert individual claims against the contractual partner in court.

Procedure

If you wish to file a complaint regarding insufficient information about the identity of the operating airline, please follow these steps:

  • Visit the federal portal verwaltung.bund.de and fill out the online form.
  • You can upload your documents directly.
  • Alternatively, you can submit your notification and the documents to the Federal Aviation Office (LBA) by email, fax, or post.
  • Upon receipt of the notification, you will receive an acknowledgment of receipt with a reference number from the LBA. If there are any ambiguities or missing information, the LBA will contact you.
  • If the LBA establishes a violation, it can initiate administrative offense proceedings against the company concerned.
  • In the event of proven violations, a fine may be imposed.
  • The LBA will inform you upon completion of the processing.
