Fine proceedings by the artists' social insurance fund for breach of obligations

If you violate certain obligations under the Artists' Social Insurance Act, you may be asked to pay a fine.

As an artist or freelance journalist insured under the Artists' Social Insurance Act, you must fulfill certain obligations. The same applies to companies subject to the levy obligation under the Artists' Social Insurance Act. The Artists' Social Insurance Fund (KSK) checks whether you have fulfilled these obligations or have acted improperly.
The KSK can issue a warning fine for a minor administrative offense.
The warning fine notice includes, among other things:

• the breach of duty, i.e., the administrative offense
• the amount of the fine
• the requirements for an effective warning
• the notice regarding your right to respond to the allegations in writing

The amount of a warning fine depends on the individual case. Depending on the violation, it can range from EUR 5.00 to EUR 55.00.
You have no right to demand that the KSK punish a minor administrative offense with a warning fine. The KSK can also initiate fine proceedings and impose a fine.

You will receive a penalty notice without prior notice:

• You will learn what regulatory offense the Künstlersozialkasse accuses you of and the amount of the warning fine.
  • By paying the fine, you agree to the warning.
  • If you do not agree with the fine and do not pay, you can make a written statement regarding the allegations.
  • If you do not pay the fine, the KSK may issue a penalty notice without further notice. This also applies if you have submitted a written statement.

The warning fine must be paid within 1 week after receiving the notice of the warning fine.
