Online erledigenIf you need to prove orderly financial circumstances to other authorities, the competent insolvency court can issue you a certificate confirming the non-existence of insolvency proceedings or an insolvency petition.
With a certificate of non-pendency of insolvency proceedings, you can prove orderly economic conditions to other bodies. To this end, the insolvency court checks whether an application for insolvency has been filed, insolvency proceedings have been opened, or an application has been rejected due to a lack of assets, and issues a certificate accordingly. In principle, you can also apply for the certificate of non-pendency through a third party. In this case, the insolvency court will additionally check whether you have a legitimate interest in the information. Therefore, a legitimate interest must be demonstrated to the court when making the application (where appropriate by submitting suitable evidence).
There are no deadlines to observe.
A fee of 15.00 euros applies.
If the issuance of the negative certificate is refused, a review of the legality can be requested pursuant to Section 23 of the Courts Constitution Act (GVG).
