If you entered Germany through the admission procedure and did not receive status as a late repatriate (Spätaussiedler/in) or as an included spouse or descendant, this classification can be reviewed upon application.

Description

After entering the Federal Republic of Germany, your status was initially checked in a reception center of the Federal Office of Administration (BVA) and possibly in a certification procedure of the Federal Office of Administration or a federal state (until 2004). If you now claim—perhaps years later—to have been classified incorrectly after all, this request can, depending on the legal situation and the course of the proceedings,

  • an application for the issuance of a notice of admission,
  • an application for the reopening of the admission or certification procedure or
  • an application for the issuance of a certificate

to be.

Procedure

You can apply for the upgrade informally in writing or online.

Written application:

  • Upon your informal application, the Federal Office of Administration will request the former procedural files, interpret the objective of your application, and decide on the application.

Online Application:

  • Go to the Federal Portal's website and fill out the application form online.
    • Note: For the online function, you need your ID card with PIN number.
  • Submit your application.
  • The BVA will review your application.

Since the Federal Administrative Court has ruled that applications for certificates must be decided based on the law in effect at the time of entry, the applications are rejected as a rule (over 99 percent).

Deadlines

  • Time limit for filing an objection: 1 month after notification
  • Time limit for filing a lawsuit: 1 month after service of the opposition decision
